1. Acceptance of Terms

By accessing and using Digital Drawer ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Digital Drawer is a web-based application that helps users organize, catalog, and track their tech inventory including gadgets, cables, connectors, and other electronic items. The Service allows users to create digital inventories of their physical items.

As part of the Service, Pro accounts include up to 150 AI recognition uses per month ("Recognitions"). Recognitions are defined as any instance where the Service analyzes, classifies, or identifies an item using AI-based recognition.

Unused Recognitions do not roll over to the following month.

Additional Recognitions may be made available through higher-tier plans or add-on purchases.

Recognition limits are designed to cover standard household usage; users requiring higher volumes should upgrade to an appropriate plan.

3. User Account and Registration

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Content and Data

You retain ownership of any content and data you upload to the Service. By using the Service, you grant us:

  • A limited license to use, store, and display your content as necessary to provide the Service
  • The right to backup and secure your data
  • Permission to use aggregated, anonymized data for service improvement

You are responsible for the accuracy and legality of all content you upload.

5. Privacy and Data Protection

We take your privacy seriously and are committed to protecting your personal information:

  • We collect only necessary information to provide the Service
  • We do not sell, trade, or rent your personal information to third parties
  • We implement appropriate security measures to protect your data
  • You have the right to access, modify, or delete your personal data
  • We comply with applicable data protection laws

6. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could harm the Service or other users:

  • Violating any applicable laws or regulations
  • Uploading malicious software, viruses, or harmful code
  • Attempting to gain unauthorized access to the Service or other user accounts
  • Interfering with the normal operation of the Service
  • Impersonating others or providing false information
  • Spamming or sending unsolicited communications
  • Using the Service for commercial purposes without permission

In addition to the restrictions above, you agree not to:

  • Attempt to bypass or manipulate Recognition limits
  • Share your account for the purpose of pooling or extending Recognition quotas across multiple users without authorization

7. Service Availability

While we strive to maintain high availability, the Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access and may suspend the Service for maintenance, updates, or other reasons with or without notice.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Mola & Family Co S.L and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

9. Limitation of Liability

In no event shall Mola & Family Co S.L, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Data Backup and Loss

While we implement backup procedures, you are responsible for maintaining your own backups of important data. We are not liable for any loss of data, and we recommend regularly exporting your inventory data as a precautionary measure.

11. Account Termination

We may terminate or suspend your account at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms and Conditions
  • Is harmful to other users or the Service
  • Violates applicable laws
  • Is fraudulent or involves unauthorized use

Upon termination, your right to use the Service will cease, and we may delete your account and data.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction where Mola & Family Co S.L is operated, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of that jurisdiction.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. This Terms and Conditions agreement constitutes the entire agreement between us regarding our Service and supersedes and replaces any prior agreements.

16. Refund Policy

We want you to be satisfied with your Digital Drawer Pro purchase. Our refund policy is designed to be fair and transparent:

16.1 Money-Back Guarantee

We offer a 5-day money-back guarantee for all new Pro purchases. If you are not completely satisfied with our service within the first 5 days of your purchase, you may request a full refund.

16.2 Refund Eligibility

  • Refund requests must be submitted within 5 days of the initial Pro purchase
  • Only the Pro purchase payment is eligible for refund
  • Refunds are not available for Pro purchases made more than 5 days ago
  • Refund requests must be submitted through our official support channels
  • Refund requests must include a valid reason related to service functionality or unmet expectations

16.3 Refund Process

  • Include your account email and detailed reason for the refund request
  • Valid reasons include: service not working properly, functionality issues, or unmet expectations
  • We will review your request and respond within 3-5 business days
  • Approved refunds will be processed within 5-10 business days
  • Refunds will be issued to the original payment method used for the purchase

16.4 Non-Refundable Circumstances

  • Pro purchases that have been active for more than 5 days
  • Accounts that have violated our Terms of Service
  • Refund requests submitted after account termination
  • Pro purchases made through third-party platforms (subject to their refund policies)
  • Refund requests without valid reasons related to service functionality or unmet expectations

16.5 Cancellation

Since Pro is a one-time purchase, there is no subscription to cancel. Your Pro access will remain active indefinitely. If you need to request a refund, please do so within 5 days of your purchase.

16.6 Disputes and Chargebacks

If you believe there has been an error in billing, please contact us before disputing the charge with your payment provider. Unauthorized chargebacks may result in account suspension and may affect your ability to use our services in the future.

17. Service Discontinuation

Digital Drawer is offered as a one-time purchase service without ongoing subscription fees. While we intend to provide continued access, you acknowledge and agree that Mola & Family Co S.L reserves the right to discontinue, suspend, or permanently terminate the Service at any time, at our sole discretion, with or without notice.

In the event of discontinuation, your Pro access will remain valid until the effective termination date of the Service. Because the Pro license is a one-time purchase, no refunds, credits, or compensation will be provided due to Service discontinuation, regardless of the time elapsed since your purchase.

By using Digital Drawer, you acknowledge that you have read and understood these terms and agree to be bound by them.
